Controversial apartment building in Tallinn's green area gets new owner
23.05.2007, 11:39Tallinn City Government has issued a building title to the company that is developing a complex for the elderly in Tallinn's green area Nomme.
The centre will be in the same building was erected by YIT Ehitus as a spa hotel- but was later suspended when it was claimed that the company is actually developing an apartment building.
According to the general masterplan- it is prohibited to develop multi-storey apartment buildings in the area.
YIT Ehitus was ordered to stop construction of the building of 69 apartments since by its building title the company had no right to build an apartment building in the area that is designated as a park.
After the construction was suspended- YIT repaid the 5 pct booking fee to the buyers.
YIT Ehitus was developing an apartment building with 69 apartments under the name of a sanatorium and was selling apartments at 20-000 to 23-000 kroons a square metre. Today new apartments cost about twice as much in the area.
In September the Tallinn Administrative Court ordered the construction to stop on complaints filed by two neighbours.
The buyers claim that the construction company was entitled to terminate the contract only if it violates its contractual obligations. Since it has not happened- construction must continue- they say.
